INTRODUCTION

Welcome to Pilot Lounge. These Terms of Service ("Terms") govern your access to and use of our website and aviation simulation programs ("Services"). By booking a session, purchasing a program, or using our website, you ("you," "parent," or "guardian") agree to be bound by these Terms on behalf of yourself and any minor participant in your care.

If you do not agree to these Terms, please do not use our Services.

Pilot Lounge is located in Redondo Beach, CA. These Terms are governed by the laws of the State of California.

1. ELIGIBILITY AND PARTICIPANT REQUIREMENTS

1.1 Age Requirements

Pilot Lounge programs are designed for participants ages 7-16+. All participants must meet the minimum age requirement at the time of their session.

1.2 Parental or Guardian Consent

All participants under the age of 18 must have a parent or legal guardian complete the booking process and sign all required waivers prior to participation. By completing a booking, the parent or guardian confirms they have the legal authority to consent on behalf of the minor.

1.3 Health and Physical Requirements

Participants should be in good general health. You are responsible for informing Pilot Lounge of any physical, medical, or psychological conditions that may affect a participant's ability to safely participate. Pilot Lounge reserves the right to refuse participation to any individual whose condition poses a safety risk to themselves or others.

2. BOOKINGS AND PAYMENTS

2.1 Reservations

All sessions must be booked in advance through our website or by contacting us directly. Bookings are confirmed only upon receipt of full payment unless otherwise agreed in writing.

2.2 Pricing

All prices are listed in U.S. dollars and are subject to change without notice. The price displayed at the time of booking is the price you will be charged.

2.3 Payment

We accept major credit cards and other payment methods as displayed at checkout. Payment is processed securely through our third-party payment provider. Pilot Lounge does not store your full payment card information.

2.4 Gift Cards and Vouchers

Gift cards and promotional vouchers are non-refundable, non-transferable, and have no cash value unless required by law. They must be redeemed by the expiration date if applicable.

3. CANCELLATIONS AND REFUNDS

3.1 Cancellations by You

Cancellations made 72 hours or more before your scheduled session: full refund or credit toward a future session.

Cancellations made 24–72 hours before your scheduled session: session credit only (no cash refund).

Cancellations made less than 24 hours before your scheduled session: no refund or credit.

No-shows without prior notice: no refund or credit.

3.2 Rescheduling

You may reschedule your session at no charge if done at least 48 hours in advance, subject to availability. Same-day rescheduling requests are at Pilot Lounge's discretion.

3.3 Cancellations by Pilot Lounge

In the event Pilot Lounge must cancel a session due to equipment issues, staffing, or circumstances beyond our control, you will receive a full refund or the option to reschedule at no additional charge. Pilot Lounge is not liable for any other costs incurred as a result of a cancellation (e.g., travel expenses).

3.4 Refund Processing

Approved refunds will be processed within 7–10 business days to the original payment method.

4. ASSUMPTION OF RISK AND SAFETY

4.1 Nature of Activities

Pilot Lounge provides flight simulation experiences using real simulation technology. While our programs take place in a controlled, indoor environment using simulators (not actual aircraft), participants acknowledge that any simulation activity involves physical engagement and a degree of inherent excitement and stimulation.

4.2 Voluntary Participation

Participation in Pilot Lounge programs is entirely voluntary. By booking a session, you acknowledge that you understand the nature of the activities and agree that your child's participation is voluntary and informed.

4.3 Safety Rules

All participants and accompanying adults must follow the safety instructions and guidelines provided by Pilot Lounge staff at all times. Pilot Lounge reserves the right to remove any participant from a session, without refund, if they fail to follow safety instructions, behave in a disruptive, aggressive, or unsafe manner, are under the influence of alcohol or controlled substances, or pose a risk to themselves, other participants, or staff.

4.4 Required Waiver

All participants (or their parent/guardian if under 18) must sign a liability waiver before participating. No one will be permitted to participate without a completed and signed waiver on file.

5. LIABILITY WAIVER AND RELEASE

By booking and participating in Pilot Lounge Services, you, on behalf of yourself and/or your minor child, agree to the following:

To the fullest extent permitted by applicable law, you hereby release, waive, discharge, and covenant not to sue Pilot Lounge, its owners, officers, employees, instructors, agents, and affiliates (collectively, "Released Parties") from any and all claims, demands, losses, damages, costs, and liabilities arising from or related to participation in Pilot Lounge programs, including but not limited to personal injury, illness, or emotional distress, property damage or loss, and actions of other participants or third parties.

This release applies to claims arising from the negligence of the Released Parties, except in cases of gross negligence, willful misconduct, or as otherwise prohibited by law.

Note: California law (Civil Code §1542) states that a general release does not extend to claims the releasing party does not know or suspect to exist at the time of the release. By agreeing to these Terms, you expressly waive the protections of Civil Code §1542 to the fullest extent permitted by law.

6. PHOTOGRAPHY AND MEDIA CONSENT

Pilot Lounge may photograph or video record sessions for marketing, social media, and promotional purposes. By booking a session, you grant Pilot Lounge a non-exclusive, royalty-free license to use images or footage of you and/or your child for these purposes.

If you do not consent to photography or recording, you must notify us in writing prior to your session. We will make reasonable efforts to accommodate your request.

7. INTELLECTUAL PROPERTY

All content on our website — including text, graphics, logos, images, and software — is the property of Pilot Lounge or its licensors and is protected by applicable copyright, trademark, and intellectual property laws. You may not reproduce, distribute, or use any content without our express written permission.

8. WEBSITE USE

8.1 Permitted Use

You may use our website for lawful purposes only. You agree not to use the site in any way that violates applicable laws or regulations, attempt to gain unauthorized access to any part of the site or its systems, transmit spam, malware, or harmful code, or scrape or harvest data from our website without permission.

8.2 Accuracy of Information

We strive to keep our website accurate and up to date, but we make no warranties regarding the completeness or accuracy of any content. Pricing, availability, and program details are subject to change.

8.3 Third-Party Links

Our website may contain links to third-party websites. These links are provided for convenience only. Pilot Lounge does not endorse and is not responsible for the content or practices of any third-party sites.

9. DISCLAIMER OF WARRANTIES

Our Services and website are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

10. LIMITATION OF LIABILITY

To the fullest extent permitted by California law, Pilot Lounge's total liability to you for any claim arising from or related to these Terms or our Services shall not exceed the amount you paid for the specific session giving rise to the claim.

In no event shall Pilot Lounge be liable for any indirect, incidental, special, punitive, or consequential damages, even if we have been advised of the possibility of such damages.

11. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Pilot Lounge and its Released Parties from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of our Services or website, your violation of these Terms, any misrepresentation you make in connection with a booking, or your child's conduct during a session.

12. DISPUTE RESOLUTION

12.1 Informal Resolution

Before filing any formal legal action, you agree to contact us at Info@PilotLoungeSim.com and attempt to resolve the dispute informally. We will make good-faith efforts to resolve the matter within 30 days.

12.2 Binding Arbitration

If informal resolution fails, any dispute arising from these Terms or our Services shall be resolved by binding arbitration administered by JAMS in accordance with its rules, conducted in Redondo Beach, CA. The arbitrator's decision shall be final and binding.

12.3 Class Action Waiver

You agree to resolve disputes with Pilot Lounge on an individual basis only. You waive any right to participate in a class action lawsuit or class-wide arbitration.

12.4 Governing Law

These Terms shall be governed by the laws of the State of California, without regard to its conflict of law principles.

13. CHANGES TO THESE TERMS

We reserve the right to update these Terms at any time. Changes will be posted on this page with a revised "Last Updated" date. Your continued use of our Services after changes are posted constitutes acceptance of the revised Terms.
